DoctorQueue Terms and Conditions

Thamira Technology LLP, along with its affiliates and group companies operating under the brand name DoctorQueue (“DoctorQueue”), serves as the creator and publisher of the online platform available at www.doctorqueue.com and the DoctorQueue mobile application (collectively referred to as the “Website”).

1. NATURE AND APPLICABILITY OF TERMS                       

Before accessing the Website or utilizing the services offered by DoctorQueue, we request you to carefully review these Terms and Conditions (“Terms”) along with our Privacy Policy, which is available at https://www.doctorqueue.com/company/privacy-policy (“Privacy Policy”). These Terms, together with the Privacy Policy, form a legally binding Agreement between you and DoctorQueue governing your access to the Website and usage of its services.

This Agreement is applicable to you if you fall into any of the following categories:

  • i. A medical professional or healthcare provider (either an individual practitioner, organization, or healthcare institution), including authorized representatives of such entities, seeking to be listed or already listed on the Website (“Practitioner(s),” “you,” or “User”);
  • ii. A patient or an individual representing a patient, using the Website to search for medical practitioners (“End-User,” “you,” or “User”);
  • iii. Any other visitor accessing the Website for any purpose (“you” or “User”).

This Agreement governs all Services provided by DoctorQueue through the Website, including but not limited to:

  • iv. For Practitioners: The listing of healthcare providers, their profiles, and contact details, making them accessible to other users and visitors.
  • v. For other Users: Features such as (i) creating and maintaining DoctorQueue User Profile, (ii) searching for practitioners based on name, specialty, location, or other criteria introduced by DoctorQueue, and (iii) booking appointments with listed practitioners.

The Services offered may evolve over time at the sole discretion of DoctorQueue, and this Agreement will apply to your continued use of the Website and the Services, along with any information you provide.

This Agreement outlines the terms and conditions under which you may use the Website and details how we handle your account while you are registered as a member. If you have any questions regarding any aspect of this Agreement, feel free to reach out to us at support@doctorqueue.com.

By accessing, downloading, or using the Website, you explicitly agree to comply with all the terms outlined in this Agreement and our Privacy Policy. These Terms override any previous verbal or written agreements concerning your use of the Website. Your continued use of any service on the Website signifies your consent to these terms.

We reserve the right to modify or discontinue any portion of this Agreement at any time, and such updates will be communicated via digital channels. You are encouraged to review the Agreement periodically, as continued usage of the Website implies acceptance of any modifications.

By using DoctorQueue Website, you acknowledge and accept that this Agreement binds you legally for all Services you choose to avail. If you do not agree with any provision stated herein, kindly refrain from accessing the Website or using its Services.

Access to and use of the Website and Services is entirely at the sole discretion of DoctorQueue.

This Agreement has been drafted in accordance with and is governed by Indian law, including but not limited to:

  • i. The Indian Contract Act, 1872,
  • ii. The Information Technology Act, 2000, and
  • iii. Relevant rules, regulations, and guidelines, such as:
    • The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (SPI Rules), and
    • The Information Technology (Intermediary Guidelines and Digital Ethics Code) Rules, 2021 (IG Rules).

2. CONDITIONS OF USE

To register, access the Services, or use the Website in any way, you must be at least 18 years old. By signing up, browsing, or utilizing the Website, or by agreeing to these Terms, you confirm and guarantee to DoctorQueue that you are 18 years or older. Additionally, you affirm that you possess the legal right, authority, and ability to access the Website and its Services and that you agree to comply with the terms outlined in this Agreement.

3. TERMS OF USE APPLICABLE TO USERS OTHER THAN PRACTITIONERS

The provisions outlined in this Section 3 are specifically applicable to Users who are not Practitioners.

3.1 USER ACCOUNT AND DATA PRIVACY

3.1.1 The definitions of “personal information” and “sensitive personal data or information” are as per the SPI Rules and are detailed in the Privacy Policy.

3.1.2 Through its Services, DoctorQueue may collect information related to the devices used to access the Website, as well as anonymized data regarding user activity. This data is solely used to enhance service quality and facilitate the development of new features.

3.1.3 DoctorQueue is granted access to registered Users’ email addresses and phone numbers through the Website. This access is utilized for communication purposes, ensuring a seamless appointment booking experience and gathering feedback regarding Practitioners and their services.

3.1.4 The Privacy Policy comprehensively outlines:

  • The categories of information collected from Users, including sensitive personal data.
  • The purpose, methods, and manner in which such information is utilized.
  • The entities or individuals with whom DoctorQueue may share this information.
  • Other relevant details mandated under the SPI Rules.

3.1.5 Users are advised to thoroughly review and understand the Privacy Policy to be aware of, among other things:

  • The nature of the information being collected.
  • The reasons for collecting such information.
  • The intended recipients of the information.
  • The process of data collection and its retention period.
  • The identity and contact details of the entity collecting and storing the data.
  • The rights available to Users concerning their personal information.

3.1.6 DoctorQueue does not take responsibility for the accuracy, validity, or authenticity of any personal or sensitive data provided by Users, whether to DoctorQueue directly or to any third party acting on its behalf.

3.1.7 Users are solely responsible for maintaining the confidentiality of their account credentials and passwords when registered on the Website. Any activity carried out under the User’s account, whether authorized or unauthorized, remains the User’s responsibility. If there is any suspected or actual unauthorized use of an account or password, the User must promptly notify DoctorQueue. While DoctorQueue is not liable for any loss incurred due to unauthorized access, the User may be held accountable for any losses suffered by DoctorQueue or others as a result of such unauthorized usage.

3.1.8 If any information provided by a User is found to be false, inaccurate, outdated, or incomplete—or if DoctorQueue has reason to believe so—it reserves the right to terminate or suspend the User’s access to Services at its sole discretion.

3.1.9 DoctorQueue may utilize collected user data, from time to time, to resolve customer support issues and improve the overall user experience.

3.2 RELEVANCE ALGORITHM

DoctorQueue’s relevance algorithm for Practitioners operates as a fully automated system that organizes and displays Practitioner profiles along with details of their practice on the Website. The placement of these listings does not reflect any fixed ranking or endorsement by DoctorQueue. Additionally, DoctorQueue shall not be held responsible for fluctuations in the relevance of Practitioners appearing in search results, as these rankings may change periodically. The listing of Practitioners is determined by an automated system that processes multiple factors, including User inputs such as reviews and feedback. These parameters may evolve over time to refine the listing algorithm. Under no circumstances shall DoctorQueue be held liable for the accuracy or order of Practitioner listings displayed on the Website.

3.3 LISTING CONTENT AND INFORMATION DISTRIBUTION

3.3.1 DoctorQueue, either directly or indirectly, gathers and presents pertinent details regarding the profiles and practices of Practitioners listed on the Website. This includes but is not limited to their area of expertise, qualifications, consultation fees, location, and visiting hours. DoctorQueue makes reasonable efforts to update this information periodically. Although the platform verifies and reviews the details and images provided by Practitioners, it cannot be held responsible for any discrepancies or incomplete representations, despite its best efforts.

3.3.2 The Services offered by DoctorQueue, as well as those provided by its licensors or service partners, are made available on an “as is” and “as available” basis, without any guarantees or warranties—whether express or implied—concerning merchantability, accuracy, suitability for a specific purpose, ownership rights, or non-infringement. DoctorQueue does not provide any explicit or implied representations or guarantees regarding the Website or its Services. Furthermore, DoctorQueue does not warrant the accuracy or completeness of any content or information contributed by Users on the Website. To the maximum extent permitted by law, DoctorQueue disclaims all liabilities arising from Users’ reliance on the Website, its Services, statements made by other Users, content shared by Users, or opinions expressed by DoctorQueue or any User concerning another User or their services.

3.3.3 The Website may include links to third-party websites, affiliates, and business partners. DoctorQueue neither exercises control over these external sites nor assumes responsibility for the content, accuracy, reliability, or quality of the materials available on or through these linked websites. The inclusion of any external link does not constitute an endorsement by DoctorQueue. Users access and utilize such links entirely at their own risk.

3.3.4 DoctorQueue bears no responsibility for any potential damages or malware infections that may affect Users’ devices as a result of accessing, browsing, or downloading any materials—including text, images, videos, or audio content—from the Website. If a User finds the Website unsatisfactory, their sole recourse is to discontinue its use.

3.3.5 In the event that DoctorQueue determines that a User has submitted fraudulent, incorrect, or incomplete information—whether through profile details or feedback—the platform reserves the right to immediately suspend access to the Website or any associated accounts. Additionally, DoctorQueue may publish a notice on the Website, alongside the User’s or their clinic’s name, to safeguard its business interests and protect other Users. The User shall be liable to indemnify DoctorQueue for any financial or reputational losses resulting from deceptive practices or misleading feedback that negatively impact DoctorQueue or its Users.

3.4 Appointment Booking and Practitioner Engagement

Users have multiple options to schedule an appointment with a Practitioner through DoctorQueue:

  1. a) Through the DoctorQueue mobile application, where they can browse available Practitioners and book appointments conveniently.

3.4.1 DoctorQueue strives to ensure that Users receive a confirmed appointment when booking through the platform. However, DoctorQueue bears no responsibility if the appointment is later canceled by the Practitioner or if the Practitioner becomes unavailable at the scheduled time.

3.4.2 The search results displayed on the Website for Practitioners are solely based on system algorithms and should not be considered as an endorsement by DoctorQueue. Users who choose to consult a Practitioner do so at their own discretion and risk.

3.4.4 DoctorQueue functions solely as a platform facilitating appointment scheduling and does not provide medical services, healthcare advice, or diagnoses. Therefore, DoctorQueue is not liable for:

  • Any discussions, consultations, or disputes that arise between the User and the Practitioner.
  • The competence, intention, or ability of the Practitioner to fulfill their professional duties towards the User.
  • Any incorrect prescriptions, inadequate treatment, or medical negligence on the part of the Practitioner.
  • Any inconvenience, mistreatment, or dissatisfaction resulting from the Practitioner’s failure to deliver expected healthcare services.
  • Any misconduct or unprofessional behavior exhibited by the Practitioner or their support staff.

3.4.5 Users are encouraged to share their feedback regarding their consultation experiences. However, any reviews or feedback must comply with applicable laws and guidelines. While DoctorQueue values User input, it is not obligated to act upon such feedback, including requests for removing a Practitioner from the platform.

  1. b) Users may also visit the hospital in person and request the hospital administration to book an appointment on their behalf.
  2. c) Alternatively, Users can contact DoctorQueue’s support team, who will facilitate the appointment booking process.

3.5 Cancellation, Refund, and No-Show Policy

At DoctorQueue, we are committed to providing a smooth and efficient appointment booking experience. To ensure fair usage and prevent misuse, the following Cancellation, Refund, and No-Show Policy applies:

3.5.1 Free Appointment Booking

  • Users can book appointments at no cost through the DoctorQueue platform.
  • There are no upfront charges for scheduling an appointment.

3.5.2 Appointment Cancellation Policy

  • Users can cancel up to three (3) appointments per calendar month free of charge.
  • Cancellations can be made through the DoctorQueue mobile app or by contacting customer support.
  • From the 4th cancellation onwards within the same calendar month, a penalty fee of ₹100 per cancellation will be deducted from the User’s account balance.

3.5.3 No-Show Policy

  • If a User fails to show up for a booked appointment without canceling it in advance or informing customer support, it will be marked as a No-Show.
  • A No-Show will be considered equivalent to a cancellation and will count towards the three free cancellations allowed per month.
  • If a User exceeds the allowed three (3) cancellations/No-Shows within a calendar month, the penalty rules (outlined in 3.5.4) will apply.

3.5.4 Penalty and Account Balance Requirement

  • Once a User reaches three (3) cancellations or No-Shows in a calendar month, they must pay ₹200 to activate their account for further bookings.
  • The ₹200 amount is credited to the User’s account balance and can be used for future penalties.
  • From the 4th cancellation or No-Show onwards within the same calendar month, ₹100 will be deducted from the User’s account balance for each additional cancellation or No-Show.
  • If the User’s account balance is depleted, they must recharge their account before booking new appointments.

3.5.5 Refund Policy

  • The ₹200 account balance is non-refundable, but it will remain available for future penalty deductions.
  • There are no refunds for penalty charges deducted due to excessive cancellations or No-Shows.

3.5.6 Exceptions & Support

  • In case of genuine emergencies or unavoidable circumstances, Users may contact DoctorQueue customer support for a review of their case.
  • DoctorQueue reserves the right to waive penalties in exceptional cases, at its sole discretion.

By booking an appointment through DoctorQueue, Users agree to comply with this policy. This policy is designed to encourage responsible appointment management and reduce inconvenience for both Practitioners and other Users.

3.6 Informational Use Only – No Medical Advice or Emergency Assistance

3.6.1 Informational Purpose Only

Some of the content, including text, data, graphics, images, information, suggestions, guidance, and other materials (collectively referred to as “Information”), available on the DoctorQueue platform, may come from individuals in the medical field.

The presence of such Information does not establish a licensed medical professional-patient relationship between DoctorQueue and the User.

This Information should not be interpreted as a medical opinion, diagnosis, treatment recommendation, or professional advice. Its sole purpose is to assist Users in finding and connecting with qualified healthcare practitioners.

3.6.2 Disclaimer of Responsibility

Any Information provided on the DoctorQueue platform, including contributions from employees, contractors, partners, sponsors, advertisers, or licensors, is purely for informational purposes.

DoctorQueue makes no warranties or guarantees, express or implied, regarding the accuracy, expertise, professional qualifications, or quality of work of any medical practitioner listed on the platform.

Users should exercise their own judgment before relying on any information provided. DoctorQueue shall not be held liable for any decisions or actions taken based on such Information.

3.6.3 Not a Substitute for Emergency Services

The services offered through DoctorQueue are not intended to replace emergency medical care.

If a User is experiencing a medical emergency, whether for themselves or someone else, they should immediately contact an ambulance service or visit the nearest hospital.

DoctorQueue does not provide emergency response services and cannot be relied upon in urgent or life-threatening situations.

3.7 Content Ownership, Usage Limits, and Copyright Policy

3.7.1 Ownership of Content

The content available on the DoctorQueue platform consists of either (i) user-generated content or (ii) content owned by DoctorQueue.

Any information collected from Users and Practitioners, whether directly or indirectly, is the exclusive property of DoctorQueue.

Copying, reproducing, or using DoctorQueue’s copyrighted material for commercial gain or any profit-driven purpose is strictly prohibited. Any such violation may result in legal action under applicable copyright laws.

3.7.2 Authorized Access and Use

DoctorQueue grants Users limited rights to access and view content available on the platform, strictly for the purpose of scheduling appointments, receiving services, and communication in accordance with this Agreement.

The platform’s design, logos, text, graphics, images, button icons, software code, and arrangement of content (collectively, “DoctorQueue Content”) are intellectual property owned and protected by DoctorQueue under copyright, trademark, and other relevant laws.

Users must not modify, reproduce, publicly display, distribute, or use any DoctorQueue Content for commercial, public, or personal financial gain.

3.7.3 Restriction on Monitoring and Benchmarking

Users must not access the DoctorQueue platform with the intent of monitoring its availability, performance, or functionality for competitive analysis, benchmarking, or any unauthorized purpose.

4. TERMS OF USE FOR PRACTITIONERS

The terms outlined in this section are applicable only to registered Practitioners using the DoctorQueue platform.

4.1 LISTING POLICY

4.1.1 Practitioner Profile Management

DoctorQueue collects and maintains details related to Practitioner profiles, contact information, and practice details.

The platform reserves the right to modify, remove, or display Practitioner profiles with or without prior notice to the Practitioner.

This information is maintained to enhance interaction between Practitioners and Users. If any incorrect details are found on a Practitioner’s profile, it is the Practitioner’s responsibility to notify DoctorQueue immediately to facilitate corrections.

4.1.2 Search Engine Rankings

DoctorQueue does not control or influence the ranking of Practitioner profiles on external search engines or third-party websites and shall not be held liable for any discrepancies.

4.1.3 Liability for Disclosures

DoctorQueue shall not be held responsible for any losses, damages, or liabilities resulting from disclosures made by the platform when the User has explicitly or implicitly consented to such disclosures.

If a User revokes consent under the Privacy Policy, DoctorQueue will not be liable for any disclosures made prior to receiving such revocation.

4.1.4 Moderation of Practitioner-Provided Content

DoctorQueue reserves the right to moderate, modify, or remove any suggestions, feedback, or content submitted by Practitioners if found to be abusive, inappropriate, or promotional in nature.

However, DoctorQueue does not guarantee that all Practitioner profiles listed on the platform are active, accurate, or legitimate, and shall not be held responsible for any fraudulent or non-existent listings.

4.1.5 Third-Party Content Sharing

Practitioners acknowledge and agree that DoctorQueue holds the right to publish, share, or distribute Practitioner-provided content with third-party platforms or content distribution services.

4.1.6 Compliance with Legal Requirements

Practitioners represent and warrant that their use of DoctorQueue’s services will be in full compliance with applicable laws.

Any violation of the law arising from a Practitioner’s use of the platform is solely the Practitioner’s responsibility, and DoctorQueue shall not be held accountable for any legal consequences.

4.2 PROFILE OWNERSHIP AND EDITING RIGHTS

  • DoctorQueue provides Practitioners with an easy-to-use tool for updating their profile information.
  • While Practitioners can request changes, DoctorQueue retains full ownership of all Practitioner profiles, including photographs, and reserves the right to review and moderate any updates or modifications.
  • DoctorQueue holds the discretion to approve or reject requests for changes without prior notice.
  • Practitioners represent and warrant that they have legal authorization to upload all content associated with their profile and that such content does not infringe upon any third-party rights, including intellectual property.
  • If DoctorQueue becomes aware of any violations, it may alter or remove specific portions of a profile at its sole discretion, with or without informing the Practitioner.

4.3 PATIENT FEEDBACK DISPLAY RIGHTS OF DOCTORQUEUE

4.3.1 Critical Content Policy

All Critical Content on the DoctorQueue platform is generated by Users, including End-Users, clients, and Practitioners.

DoctorQueue acts as an intermediary under the Information Technology Act, 2000, and is not responsible for the accuracy or nature of Critical Content.

4.3.2 Collection of Feedback

DoctorQueue reserves the right to collect feedback and Critical Content related to all Practitioners, Clinics, and Healthcare Providers listed on the platform.

4.3.3 No Obligation to Review Content

DoctorQueue is not required to pre-screen, monitor, modify, flag, filter, or remove Critical Content unless mandated by applicable law.

4.3.4 Disclaimer on Negative Content

By using DoctorQueue’s services, Practitioners acknowledge that they may encounter Critical Content that could be offensive or objectionable.

DoctorQueue shall not be held liable for any negative impact on a Practitioner’s business due to such content. However, as an intermediary, DoctorQueue complies with all applicable laws regarding content moderation.

4.3.5 Compliance with Applicable Laws

DoctorQueue will remove content if it violates legal standards but bears no responsibility for user-generated Critical Content.

The principles governing third-party content outlined in the Website’s Terms of Service also apply to Critical Content.

4.3.6 Fraudulent Feedback and Misrepresentation

If DoctorQueue determines that a Practitioner has submitted false information or engaged in manipulating reviews, it reserves the right to suspend the Practitioner’s account immediately.

DoctorQueue may also display a public notice alongside the Practitioner’s profile or clinic name to inform Users of the fraudulent activity.

4.4 RELEVANCE ALGORITHM

DoctorQueue’s proprietary relevance algorithm is designed to provide high-quality results to End-Users.

The algorithm is merit-based and may be periodically updated to enhance the user experience.

DoctorQueue does not allow manual intervention to alter rankings for specific Practitioners and is not responsible for any impact on a Practitioner’s business due to algorithmic changes.

4.5 INDEPENDENT SERVICES

Each service offered by DoctorQueue is independent of the others.

Practitioners using one service do not automatically acquire rights or obligations concerning other services provided by DoctorQueue.

4.6 DOCTORQUEUE REACH RIGHTS

DoctorQueue reserves the right to display sponsored advertisements on the Website, which will be clearly labeled as “Sponsored Ads”.

While DoctorQueue ensures transparency, it does not verify the accuracy of claims made in Sponsored Ads.

Users are not encouraged to interact with Sponsored Ads or avail services from advertisers, and DoctorQueue bears no responsibility for their offerings.

Practitioners warrant that they will comply with applicable laws while using the platform, and any legal violations arising from usage are their sole responsibility.

4.9 PRACTITIONER UNDERTAKING

Practitioners confirm that they are licensed, registered, and qualified to practice medicine or offer healthcare services as per applicable laws.

They shall not engage in any arrangements that restrict their ability to practice medicine within India.

Practitioners must ensure full compliance with legal regulations and uphold the highest standards of care while offering services.

4.10 USAGE IN PROMOTIONAL & MARKETING MATERIALS

In recognition of its services, DoctorQueue may feature Practitioners in various promotional and marketing materials, subject to Practitioner approval.

  • Practitioners agree to allow DoctorQueue to:
  • Describe their services in promotional content.
  • Reference them in case studies, marketing materials, and testimonials.
  • List them as a reference for potential clients.
  • Use their name, logo, and brand imagery in advertising, social media, emailers, and product literature.
  • Include their feedback in press releases, news interviews, banners, and promotional videos.
  • Invite them to participate in conferences, presentations, and media interactions.

By agreeing to these terms, Practitioners acknowledge and authorize DoctorQueue to use their details for marketing purposes, ensuring wider visibility and engagement in the healthcare community.

5. RIGHTS AND OBLIGATIONS RELATING TO CONTENT

5.1 In accordance with Regulation 3(2) of the IG Rules, DoctorQueue hereby notifies Users that they must not host, display, upload, modify, publish, transmit, update, or share any content that:

  1. belongs to another individual and to which the User does not have rightful ownership;
  2. is excessively harmful, harassing, defamatory, obscene, pornographic, pedophilic, blasphemous, libelous, invasive of privacy, racially or ethnically offensive, disparaging, promoting money laundering or gambling, or otherwise illegal in any manner;

iii. causes harm to minors in any form;

  1. infringes upon any patent, trademark, copyright, or proprietary rights of another entity;
  2. violates any current law in effect;
  3. misleads or deceives the recipient about the origin of messages or includes content that is grossly offensive or threatening in nature;

vii. impersonates another person;

viii. contains software viruses or any computer code, files, or programs designed to disrupt, damage, or limit the functionality of any computer system;

  1. threatens national unity, integrity, defense, security, sovereignty of India, friendly relations with foreign nations, public order, incites criminal activity, obstructs law enforcement, or insults any other country.

 5.2 Users must not:

  1. attempt to violate the security or integrity of the Website or any DoctorQueue Content;
  2. transmit any content (such as job postings, messages, hyperlinks) on the Website that disrupts or competes with DoctorQueue’s services;

iii. submit incomplete, false, or misleading information on the Website;

  1. send unsolicited communications to other Users;
  2. use automated engines, software, tools, agents, or mechanisms (such as spiders, robots, avatars, or intelligent agents) to navigate or search the Website;
  3. attempt to decipher, decompile, disassemble, or reverse engineer any portion of the Website;

vii. duplicate, copy, or reproduce any DoctorQueue Content or other information available from the Website in any way;

viii. frame, hotlink, or deep-link any DoctorQueue Content;

  1. circumvent or disable any digital rights management, usage rules, or security features implemented in the Software.

5.3 If DoctorQueue, either through its own assessment or upon notification by an affected individual in writing or electronically signed email, becomes aware of any information violating Clauses 5.1 and 5.2, it holds the right to disable access to such content. Furthermore, DoctorQueue reserves the right to retain such information and related records for a minimum of 90 (ninety) days for submission to relevant government authorities for investigation.

 5.4 If a User fails to comply with any applicable laws, rules, regulations, or the Agreement (including the Privacy Policy), DoctorQueue has full authority to immediately revoke the User’s access and usage rights for the Website and Services. Additionally, any non-compliant content may be removed from the Website without prior notice.

5.5 DoctorQueue may disclose or transfer User-generated content to its affiliates or government authorities in compliance with applicable laws, with the User’s consent. The SPI Rules allow DoctorQueue to transfer sensitive personal data or information to other corporate bodies or entities within India or internationally, provided they maintain an equivalent level of data protection as adhered to by DoctorQueue. Such transfers occur only when necessary for fulfilling a lawful contract between DoctorQueue and the User or upon explicit consent of the User.

DoctorQueue acknowledges and respects the intellectual property rights of third parties. However, it does not assume responsibility for any infringement of intellectual property rights by Users.

6. TERMINATION OF ACCESS AND SERVICE RESTRICTIONS

6.1 DoctorQueue retains the authority to suspend or revoke a User’s access to the Website and Services, with or without prior notice, and may take any legal action deemed necessary in the following situations:

  1. The User violates any terms and conditions outlined in this Agreement;
  2. A third party raises a complaint regarding an infringement of their rights due to the User’s utilization of the Services;

iii. DoctorQueue is unable to verify or authenticate the information provided by the User;

  1. DoctorQueue has reasonable suspicion of unlawful, fraudulent, or abusive behavior associated with the User;
  2. DoctorQueue, at its sole discretion, determines that the User’s actions could result in legal consequences for the User, other Users, or DoctorQueue, or if such actions are deemed contrary to the interests of the Website.

6.2 Upon temporary suspension, indefinite suspension, or termination, the User shall not be allowed to continue using the Website under the same account, a different account, or by re-registering under a new account. If an account is terminated for any of the aforementioned reasons, the User will lose access to data, messages, files, and any other content stored on the Website. It is the User’s responsibility to maintain an ongoing backup of any medical services they have provided to comply with their record-keeping requirements and protocols.

7. LIMITATION OF LIABILITY AND DISCLAIMER OF DAMAGES

Under no circumstances, including but not limited to negligence, shall DoctorQueue, along with its directors, officers, employees, agents, or content and service providers (collectively referred to as “Protected Entities”), be liable for any direct, indirect, special, incidental, consequential, exemplary, or punitive damages resulting from, or directly or indirectly related to, the use or inability to use the Website, any related content, materials, functions, or Services, any information provided by the User through the Website, business losses, or lost End-Users, even if the Protected Entities have been informed of the potential for such damages.

The Protected Entities shall not be held liable for:

o The provision or failure to provide services by Practitioners to End-Users who have been contacted or managed via the Website;

o Any content that is posted, transmitted, exchanged, or received by any User or third party on or through the Website;

o Unauthorized access, modifications, or alterations of User transmissions or data;

o Any other matters related to the Website or Services.

The total cumulative liability of the Protected Entities to any User, for all claims, damages, and causes of action, whether based on contract, tort (including negligence), or any other legal theory, shall not exceed a total aggregate amount of Rs. 1000/- (Rupees One Thousand Only).

8. DATA RETENTION AND INFORMATION REMOVAL POLICY

DoctorQueue reserves the right to retain information obtained from Users through its Website or Services for a duration deemed necessary based on the nature of the information, its intended purpose, methods of utilization, and in compliance with the SPI Rules. Computer web server logs may be maintained for as long as deemed administratively required.

9. APPLICABLE LAW AND DISPUTE RESOLUTION

9.1 You acknowledge and agree that this Agreement, along with any contractual obligations between DoctorQueue and the User, shall be governed by the laws of India.

9.2 Any disagreement, dispute, or claim arising out of or in connection with this Agreement, including matters concerning its applicability, interpretation, or your use of the Website, Services, or any related information, shall be resolved through arbitration in India. A sole arbitrator, appointed by DoctorQueue, will oversee the proceedings, which shall adhere to the Arbitration and Conciliation Act, 1996. The arbitration shall take place in Tenkasi, and all proceedings, including any final awards, will be conducted in English. The arbitrator’s decision shall be final and binding on all involved parties.

9.3 Subject to Clause 9.2 above, any legal matters arising from or related to this Agreement, your use of the Website, Services, or any associated information shall fall under the exclusive jurisdiction of the courts in Tenkasi.

10.2 In compliance with the Information Technology Act, 2000, and the applicable rules, Users who have concerns regarding the Website or Services, including discrepancies or grievances related to information processing, may contact DoctorQueue’s designated Grievance Officer, Anshul Mittal, through the “Contact Us” page.

If any User experiences hardship due to unauthorized access or use of the Website in violation of Rule 3 of the IG Rules, such grievances should be directed to the aforementioned Grievance Officer.

11. SEVERABILITY AND ENFORCEABILITY

Should any provision within this Agreement be deemed unenforceable by a court of competent jurisdiction or an arbitral tribunal under applicable law, that particular provision shall be considered excluded from this Agreement. The remaining provisions shall remain valid and enforceable as if the excluded provision had never been a part of the Agreement. However, the Agreement shall still be interpreted in a manner that upholds the essence and intended purpose of the excluded provision to the greatest extent permissible under applicable law.

12. WAIVER OF RIGHTS AND NON-EXCUSABILITY OF BREACH

No term or provision within this Agreement shall be considered waived, nor shall any breach be excused, unless explicitly agreed to in writing and signed by DoctorQueue. Any consent or waiver granted by DoctorQueue concerning a breach by the User—whether expressed or implied—shall not be considered a waiver, consent, or excuse for any different or subsequent breach.
